What we collect/process and why

We may collect/process the following personal and sensitive information as part of our legal obligations, including but not limited to:

  • Your name, address and contact details, including email address and telephone number
  • Your date of birth
  • Information regarding your ethnicity, race, marital status, gender, religion, sexual orientation
  • Your National Insurance Number, Passport number
  • Your criminal record
  • Your financial information
  • Your health information
  • Details of your relationships with other individuals
  • Information provided by you and relating to your interactions with MDDC and the services that we provide

Some of the information that you provide to the Council is passed to our service so that we can provide the Council with legal advice and representation. Collecting/Processing the above types of data is necessary to ensure we can provide that service.

Depending on the nature of the issue, processing your personal data will come under one of the following legal bases:

  • We need it to comply with a legal obligation
  • We need it to perform a task in the public interest
  • We have a recognised legitimate interest
  • We need it to fulfil our contractual obligations 

We are required by the following laws to process your personal and sensitive data appropriately:

  • Data Protection Act 2018 (as amended)
  • UK General Data Protection Regulation
  • Regulation of Investigatory Powers Act 200
  • Equality Act 2010 

 

Who will receive and see the personal data?

We MAY share your information with the following third parties for the reasons detailed above and where permissible by law:

  • Central Government Agencies (e.g. Home Office, HM Revenues & Customs, Department of Works and Pensions),
  • Other Public Bodies (e.g. Land Registry, National Highways, Health and Safety Executive, Crown Prosecution Service)
  • Health Agencies (including GPs)
  • Police, Regulatory & Judicial Agencies (e.g. the Information Commission, Courts, Tribunals)
  • Other Local Authorities such as Devon County Council, parish/town councils
  • Legal representatives of other parties
  • Your nominated legal representative
  • Other crime prevention agencies in the UK
  • External Legal advisors to the Council - Solicitors and Barristers' and their admin support colleagues
  • Experts appointed to assist the Council, either directly or as joint Experts (e.g. Surveyors)
  • Insurers and Auditors
  • Elected Members of the Council
  • Other MDDC Departments
  • Process Servers, Investigators, Bailiffs,
  • Deputies appointed by the Court of Protection and Attorneys appointed under Lasting Powers of Attorney
  • Third Party organisations such as Churches Housing Action Group (CHAT)
  • As part of legal proceedings, we may also be ordered to disclose information that you provide to us to other parties to those proceedings.

Your personal information will be stored securely and will not be accessible to anyone else, including other services within MDDC, unless detailed above.

Retention

All your personal information will be held by us only for as long as is necessary and then in accordance with any legal requirements imposed upon us and MDDC’s retention schedule. For more information please go to our website to view our Retention Schedule.

 

Transferring personal information outside the EU

Your personal information will not be transferred outside the EU or to any international organisations by MDDC. It should be noted that  MDDC has no control over those accessing its online public registers nor what someone does with any information they obtain from them.

 

Your rights

Whatever our use of your personal information you have the right of access to that personal information (including confirmation that we are using your personal information, access to it as well as other detail) and the right to seek rectification if the information is inaccurate.

As we are processing your personal data on the basis of public task and legal obligation, you have the right to object and to restrict processing.

Also, if you object to our use of your personal information and there is no overriding legitimate interest for us to continue using it or we have used your personal information unlawfully or it is no longer necessary for us to have the personal information, the right to erasure is also available to you.

Complaints

If you are dissatisfied with the way MDDC  has used your personal information then you may wish, in the first instance, to make a complaint to the Data Protection Officer. This can be done by:

Alternatively, or if you remain dissatisfied following your complaint to the Data Protection Officer, you may lodge a complaint with The Information Commission. The Information Commission is the UK’s independent body set up to uphold information rights. The IC can help and advise you on all matters relating to data protection.
