What we collect and why

We MAY collect the following personal information to deliver and meet our Waste Management obligations:

  • Name
  • Address
  • Contact Details (Email, Telephone Numbers etc)
  • Date of Birth
  • Bank Details
  • Proof of Address
  • Photographs
  • Medical Health
  • Vehicle Registration Numbers

We are collecting your personal data for the following purposes:

  • To meet our statutory obligation for the collection, transportation and processing of waste. This includes rubbish, recycling, garden waste, food waste, medical waste, and bulky waste.
  • To carry out ‘Grounds Services’ which includes the maintenance of Council Land such as Parks, Open Spaces, Council House Gardens, and Verges.
  • The management of Cemeteries and churchyards which includes selling Graves and Plots, transferring Graves ownership, arranging Internments, ordering Memorial Plaques and Benches, and inspection of Headstones.
  • To maintain contractual agreements.
  • For the prevention and detection of Crime or Fraud.

We are required under the following legal obligations to process your personal data appropriately:

  • Data Protection Act 2018
  • Environmental Protection Act 1990
  • The Revised EU Waste Framework Directive 2008
  • The Waste (England and Wales) Regulations 2011
  • Local Authority Cemeteries Order 1977
  • Allotments Act 1950
  • Health & Safety at Work Act (1974)

Who will receive and see the personal data

We MAY share your information with the following third parties for the reasons detailed above:

  • Other Council Departments such as Finance or Legal for example
  • Statutory undertaker and other public bodies
  • Environment Agency
  • Other Local Authorities i.e. Devon County Council
  • Policing Authorities
  • Public Health England
  • DEFRA
  • Providers of goods and services
  • External Contractors working on behalf of the Council

As well as information received directly from yourself, we MAY also receive information about you from:

  • Other Council Departments
  • Partners and other public bodies
  • External Contractors working on behalf of the Council

Your personal information will be stored securely and will not be accessible to anyone else, including other services within the Council, unless detailed above.

Retention

All your personal information will be held by us only for as long as is necessary and then in accordance with any legal requirements imposed upon us and the MDDC’s retention schedule. For more information please go to our website to view our Retention Schedule.

Transferring personal information outside of the EU

Your personal information will not be transferred outside the EU or to any international organisations by the Council. It should be noted that the Council has no control over those accessing its online public registers nor what someone does with any information they obtain from them.

Your rights

Whatever our use of your personal information you have the right of access to that personal information (this means confirmation that we are using your personal information, access to it as well as other detail) and the right to seek rectification if the information is inaccurate.

 As we are processing your personal data on the basis of public task and legal obligation, you have the right to object and to restrict processing.

 Also, if you object to our use of your personal information and there is no overriding legitimate interest for us to continue using it or we have used your personal information unlawfully or it is no longer necessary for us to have the personal information, the right to erasure is also available to you.

Complaints

If you are dissatisfied with the way the Council has used your personal information, then you may wish in the first instance to make a complaint to the Data Protection Officer. This can be done by;
