Use of Artificial Intelligence (AI) in Planning Submissions

 

Introduction

The Council recognises that Artificial Intelligence (AI), including generative AI, may be used in the preparation of planning applications and supporting documents. AI may be used where it is applied responsibly, transparently and accurately. Responsibility for all submitted information remains with the applicant, agent or relevant competent professional. Generative AI includes technology capable of creating or materially altering text, images, video, audio, data, analysis or other content. AI may be used as an assistive tool or may materially influence evidence, analysis, images or conclusions. Where AI has had a material role, its use should be clearly declared.

 

When a Declaration Is Required

Applicants or agents must declare whether generative AI has been used to create or materially alter any part of a planning application or supporting material. Where AI has been used, the declaration must:

  • Identify the document, image or material affected.
  • Briefly explain how AI was used.
  • Confirm whether AI-generated or AI-assisted content has been independently reviewed or verified.
  • Confirm who remains responsible for the accuracy and content of the submission.

The declaration may be included within a Planning Statement, Design and Access Statement, covering letter, or other supporting document under a clearly identifiable heading such as Artificial Intelligence Declaration. A separate declaration form may also be submitted.

 

Applicant Responsibilities

Where AI has been used, applicants or agents must:

  • Clearly identify where generative AI has been used.
  • State the purpose and extent of its use.
  • Confirm whether AI has been used to create or materially alter images, video or other visual material, including any significant additions, removals or enhancements.
  • Ensure that all factual statements, evidence, analysis and conclusions have been appropriately checked and verified.
  • Confirm responsibility for the factual accuracy of all submitted information.
  • Confirm that the use of AI has been responsible and lawful.
  • Where professional evidence is submitted, confirm that the relevant competent professional has reviewed the material and accepts responsibility for it.

The use of AI does not remove or reduce the responsibility of the applicant, agent or relevant professional for the accuracy, reliability or conclusions of submitted evidence.

 

Exclusions

A declaration is not required for routine software functions where AI is incidental to the preparation of a submission and does not create or materially alter substantive planning content. Examples include spelling and grammar checking, routine formatting or accessibility functions, and standard background software features.

 

Purpose

The purpose of this requirement is to promote transparency and enable the Local Planning Authority, consultees and the public to understand where and how AI has been used, assess the reliability of submitted information, and identify who remains accountable for the material submitted.
