Mid Devon District Council submitted the Local Plan Review 2013 - 2033 to the Planning Inspectorate on 31 March 2017, for examination into the legal compliance and soundness of the Plan.

The Secretary of State has appointed Mr Paul Griffiths BSc (Hons) BArch IHBC to conduct the examination and to report to the Council in due course.

Following preliminary hearings in September 2018, main hearings took place at Phoenix House, Tiverton on the 14th, 15th, 19th and 20th February 2019.

Update (26 February 2019)

Main hearings for the examination of the Mid Devon Local Plan Review have now concluded. Mr Griffiths, the Planning Inspector, has indicated that he will contact the Council towards the end of March to indicate how he intends to progress the examination further. Information about this will be published on the Council’s website.


Update (22 February 2019)

The main hearings concluded on 20th February 2019. The Inspector will set out the next steps for the examination process in due course.

Inspector’s letter following the Preliminary Hearings

Following preliminary hearings in September 2018, the Council received a letter from the Inspector setting out his preliminary conclusions and advising on the next steps for the examination process. For more information, please see the Examination Hearings section below.

Update (21 September 2018)

The Preliminary hearings into Policy J27 Land at Junction 27 and associated policies SP2 Higher Town, Sampford Peverell and TIV16 Blundells School have now concluded. The Inspector will clarify the situation in relation to these policies and how the Examination will then proceed in due course.

Update (1 June 2018)

The Inspector has confirmed that the preliminary hearings into Policy J27 Land at Junction 27 and associated policies SP2 Higher Town, Sampford Peverell and TIV16 Blundells School, will take place on 20th and 21st September 2018.

After that, the Inspector will clarify the situation in relation to those policies, and how the Examination will then proceed.

Update (29 May 2018)

The Planning Inspector submitted letter ID06 to Mid Devon District Council asking the Council to review the submitted Habitat Regulations Assessment and confirm the extent to which it is legally compliant in light of the recent judgement of the Court of Justice of the European Union in People over Wind, Peter Sweetman v Coillte Teoranta (Case C-323/17).

Update (27 April 2018)

The findings of the Independent Review of the Sustainability Appraisal Update 2017, associated documents and representations received in the period 28th February to 11th April 2018 have been submitted to the Inspector.

Update (28 February 2018)

Revised hearing dates to be set following public consultation on update to Sustainability Appraisal (SA).

An opportunity for public consultation on the findings of the independent review and proposed amendments to the Sustainability Appraisal will take place between 28th February and 11th April 2018. The proposed amendments add greater clarity to the Sustainability Appraisal and do not amend the content of the Mid Devon Local Plan Review (incorporating proposed modifications) that has already been submitted to the Planning Inspectorate for examination. Revised hearing dates will be set by the appointed Inspector following this period of consultation. For more information on the public consultation please click here 

 

Update (14 September 2017)

The Planning Inspector postponed the first Examination Hearings due to take place on the 26 and 27 September at the request of Mid Devon District Council.

Having reviewed the statements received by Examination Hearing participants and having taken legal advice, Mid Devon District Council requested an adjournment of the Local Plan Hearings. This adjournment provided the opportunity for the council to commission an independent report by consultants LUC to review the Sustainability Appraisal of proposed modifications made to Mid Devon Local Plan Review.

These Inspector-led hearings were to consider the proposed leisure, tourism and retail allocation at Junction 27 of the M5 motorway (policy J27) and the housing sites at Higher Town, Sampford Peverell (policy SP2) and at Blundell’s Road, Tiverton (policy TIV16).

The Programme Officer is Robert Young, responsible for assisting the Examiner with all aspects of the examination administration. The Programme Officer is independent of the Council and works directly to the Examiner. All communications for the Examiner should be sent to the Programme Officer.
